Section 321 (De Minimis) Changes effective May 2, 2025

In a press conference hosted at the White House today, President Donald J. Trump signed an Executive Order scheduling the elimination of de minimis eligibility for products of China and Hong Kong effective May 2, 2025 at 12:01 a.m. EDT.  Articles from these countries, which would have otherwise qualified for the duty and entry free exemption, will now be subject to all existing and future tariff measures.

Packages from Macau will be under review for the next 90 days for possible exclusion from de minimis treatment as well.

Articles sent via international mail that would otherwise qualify for the de minimis exemption, will be subject to either a duty rate of 30% of their value, or $25 per item, which increases to $50 per item on June 1, 2025.  The White House fact sheet requires carriers to report these postal items and ensure payment to CBP on a set schedule, although it does not clarify how.  CBP still retains the authority to require a formal entry for any postal package as before.
