Tariff Remission Process for Certain U.S. Goods

The Government of Canada has announced a process for Canadian businesses to request tariff remission on certain goods imported from the United States.  This measure aims to provide relief in specific situations where tariffs pose challenges for importers and businesses.

Eligibility Criteria
You may be eligible to apply for remission if your situation falls under one of the following categories:

  1. Inability to Source Inputs Domestically or from Non-U.S. Sources:  If your company uses goods in its production process that cannot be sourced from Canada or reasonably from countries other than the U.S., you may qualify for tariff relief.

  2. Exceptional Circumstances with Severe Economic Impact:  The government will consider other exceptional cases that have a significant economic impact on a case-by-case basis.

 

How to Apply

To request a remission, you must prepare a detailed submission that includes the following information:

Company Overview:  Provide information about your company's operations, corporate structure, primary activities, and number of employees.

Description of Goods:  Include a detailed description of the goods, along with the 8-digit tariff classification number (and 10-digit statistical level, if applicable).

Importation Details:  Specify the volume and value of the imported goods and include customs documentation (e.g., B3 forms) and invoices showing tariffs paid if the goods have already been imported.

Sourcing Evidence:  Demonstrate efforts to source the goods or suitable substitutes from Canadian or non-U.S. suppliers by providing correspondence, requests for proposals, and other relevant evidence.

Contractual Obligations:  If applicable, outline any contractual obligations that require sourcing from U.S. suppliers.

Additional Information:  Include any other information that supports your remission request.

All remission requests should be submitted to the Department of Finance Canada via email at [email protected].  Please use "U.S. Remission" in the subject line.  Ensure any confidential information is clearly marked as such.
